1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

• "Agreement" means these Terms and Conditions together with any service schedule, residency agreement, or other document expressly incorporated by reference.
• "Kam Yin" / "We" / "Us" / "Our" refers to Kam Yin Senior Living Residence, operating at 38 Lung Cheung Road, Wong Tai Sin, Kowloon, Hong Kong.
• "Services" means the lifestyle and residency programmes we offer, including Companion Circles, the Cultural and Recreation Studio, and the Residence and Lifestyle Plan, as described on our website and in any service schedule.
• "User" / "You" / "Your" means any person who accesses our website, submits an enquiry, or enters into a service or residency arrangement with Kam Yin.
• "Content" means all text, images, documents, and other materials published on the Kam Yin website at kam-yinn.club.
• "Website" means the website located at kam-yinn.club and all related subpages.

2. Acceptance of Terms

By accessing the Website, submitting an enquiry form, or entering into any service or residency arrangement with Kam Yin, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

If you are acting on behalf of another person — for example, a family member or a person in your care — you represent that you have the authority to agree to these Terms on their behalf.

These Terms are intended for persons aged 18 years or older. Persons under 18 should not submit personal information through the Website without the consent and involvement of a parent or guardian.

3. Service Description

Kam Yin is a non-medical senior lifestyle community providing social, cultural, and residential services for older adults. Our Services are available to residents and participants located in or enquiring from Hong Kong.

Our current service offerings are:

• Companion Circles — small social gatherings through the week for tea, mahjong, card games, and shared conversation (HK$960 per month).
• Cultural and Recreation Studio — a weekly programme of calligraphy, Cantonese opera listening, music sessions, and craft afternoons (HK$2,140 per month).
• Residence and Lifestyle Plan — a furnished room with housekeeping, laundry, full dining, and open access to all social, cultural, and garden activities (HK$3,720 per month).

Kam Yin reserves the right to adjust programme schedules, session formats, and availability from time to time. We will provide reasonable notice of any material changes to enrolled participants.

4. Enquiries and Enrolment

Submitting an enquiry through the Website does not constitute a binding agreement. It is an expression of interest, and our team will follow up with further information at a time that suits you.

Enrolment in any Service or residency arrangement is formalised through a separate written agreement signed by both parties. The specific terms of that arrangement — including start dates, room details, and care expectations — will be set out in that document.

5. User Responsibilities

When using the Website or communicating with Kam Yin, you agree to:

• Provide accurate, current, and complete information in any enquiry or communication.
• Use the Website only for lawful purposes and in a manner that does not infringe the rights of others.
• Refrain from uploading or transmitting any material that is harmful, offensive, defamatory, or in breach of applicable law.
• Not attempt to interfere with, disrupt, or gain unauthorised access to any part of the Website or its underlying systems.
• Not use the Website or its Content for any commercial purpose without our prior written consent.

6. Intellectual Property

All Content on the Website — including text, photographs, illustrations, logos, and layout — is owned by or licensed to Kam Yin and is protected under applicable intellectual property laws in Hong Kong.

We grant you a limited, non-exclusive, non-transferable licence to access and view the Content for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any Content without our prior written permission.

Any feedback, suggestions, or communications you send to us may be used by Kam Yin without obligation or compensation to you.

7. Payment Terms

Monthly service fees are quoted in Hong Kong Dollars (HKD) and are payable in advance, on or before the first day of each calendar month, unless otherwise specified in your individual service agreement.

Accepted payment methods include bank transfer, cheque, and other arrangements agreed in writing at the time of enrolment.

If a monthly fee remains unpaid for more than fourteen (14) calendar days after the due date, Kam Yin may contact you to discuss the matter. We aim to handle any payment difficulties with sensitivity and discretion.

Refunds, where applicable, are governed by the terms of your individual service or residency agreement. Please speak with our team if you have any concerns about billing.

8. Service-Specific Terms

Social and Cultural Programmes: Participation in Companion Circles and the Cultural and Recreation Studio is voluntary. You are welcome to attend sessions as your schedule and preferences allow. We do not require attendance at any particular session.

Residence: The Residence and Lifestyle Plan is subject to room availability. The specific room assigned, together with any particular arrangements for housekeeping, dining preferences, or access requirements, will be agreed in your residency agreement.

Kam Yin is a lifestyle residence and does not provide medical, nursing, or clinical care. If a resident's health needs change in a way that requires ongoing medical supervision, we will work with the resident and their family to identify appropriate arrangements.

9. Disclaimers

The Content on the Website is provided for general information purposes. While we make reasonable efforts to keep it accurate and up to date, Kam Yin does not warrant that the Content is free from errors, complete, or suitable for any particular purpose.

The Website is provided on an "as available" basis. We do not represent that the Website will be uninterrupted or free from technical faults.

Nothing on the Website constitutes medical, legal, financial, or professional advice. If you have questions about a resident's medical or care needs, please consult a qualified healthcare professional.

10. Limitation of Liability

To the fullest extent permitted by Hong Kong law, Kam Yin's liability to you in connection with the Website or our Services is limited to direct losses arising from our negligence or breach of agreement.

We are not liable for any indirect, incidental, or consequential loss, including loss of data, loss of enjoyment, or losses arising from circumstances outside our reasonable control (including natural events, public health emergencies, or government restrictions).

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence.

11. Indemnification

You agree to indemnify and hold harmless Kam Yin, its staff, and associated persons from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Website in a manner that violates these Terms, your breach of any applicable law, or any misrepresentation made by you in connection with an enquiry or enrolment.

12. Termination

Either party may end a service or residency arrangement by giving notice in accordance with the terms set out in the individual service or residency agreement. Typically, one calendar month's written notice is required.

Kam Yin reserves the right to suspend or terminate a service arrangement where a participant's conduct is harmful to other residents or staff, or where a residency arrangement is no longer appropriate given a significant change in care needs.

Obligations that by their nature should survive termination — including payment of outstanding fees and intellectual property provisions — will remain in effect after any termination.

13. Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

If a dispute arises between you and Kam Yin, we ask that you first contact us directly so that we may seek an amicable resolution. Most matters can be addressed through a quiet and constructive conversation.

If informal resolution is not possible, both parties agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

14. General Provisions

• Entire Agreement: These Terms, together with any service or residency agreement and our Privacy Policy, constitute the entire agreement between you and Kam Yin with respect to your use of the Website and Services.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
• Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights in connection with a reorganisation or transfer of our operations.
• Notices: Formal notices under these Terms should be sent to us in writing at the address below or by email to [email protected].

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or operational practices. When we do, we will update the "Last Updated" date at the top of this page.
